If you are carrying on a business you MUST have regard to the requirement to register your business name. The only exception is if you are trading as a sole proprietor using your own name. In other words you do not have to register your business name if your name is Frederick John Brown and you trade as Frederick John Brown or FJ Brown or F Brown. However, you do have to register your business name if you are in business as "Brown's Electrical" or "Frederick John Brown Electrical."
Registration of business names is carried out at State and Territory level, and is considered necessary for the purposes of consumer and business protection. As such the department responsible tends to be Consumer and Business Affairs within the State/Territory authorities.
Note that registration is required in each State and Territory in which business is carried on.
